PROSECUTORS SUPERVISION OVER THE INQUIRY ABOUT POLITICAL CRIMES IN THE RUSSIAN EMPIRE (THE ORGANIZATIONAL ASPECT)

Abstract
The purpose of the article is to analyze the organizational aspects of prosecutorial supervision over the inquiry about political crimes in the Russian Empire after the judicial reform of 1864. After the judicial reform the Statute of criminal procedure entrusted the prosecution of state crimes and supervision over investigation to the prosecutors of the trial chambers, to whom all such crimes were to be reported. However, in practice, prosecutors of the trial chamber entrusted the prosecutors of the district courts to supervise the conduct of such inquiries. And prosecutors of district courts entrusted this supervision to the assistant prosecutor. The order of the Minister of justice of 1896 established that the Prosecutor of the trial chamber carried out “higher supervision and guidance” in all cases of state crimes, and, if necessary, “close supervision” over these inquiries, he could assign to one of his assistants or to a assistant of the Prosecutor of the district court. The General direction of the investigation of formal inquiries into political crimes was provided by the Ministry of justice, which established monthly reporting of prosecutors on the matter. The existing general procedure of the organization of supervision over the inquiry about state crimes and informing the authorities was not always effective, as it did not allow to make operational decisions. In this regard, the law of 7 June 1904 amended the Statute of criminal procedure and extended the general procedure of proceedings to political crimes. Now, not only at the departmental, but also at the legislative level, supervision over the inquiry about these crimes was entrusted to the Prosecutor’s office of the district courts, and the Prosecutor of the judicial chamber is entrusted with the overall management of the production of these inquiries. This transfer of prosecutorial supervision over the inquiry about political crimes from the level of the Prosecutor’s office of the trial chamber to the level of the Prosecutor’s office of the district court was due not only to the desire to make the inquiry more prompt, but also to a significant increase in the number of cases of political crimes, which the small Prosecutor’s office of the trial chamber was unable to cope. As a result, cases of political crimes were subject to the general procedure of procuratorial supervision.
