Prospects for the development of institutes of civil service and administrative justice in Ukraine

Abstract
The article is devoted to the topical issue – formation of a new approach to administrative and legal support to the further development of the institutes of civil service and administrative justice. In particular, it is stressed that the domestic government machine needs immediate improving taking into account incidence of corruption in Ukraine, an unpromising situation of implementation of the functions and tasks entrusted to the state and self-governing The theoretical basis and the legal tool for appropriate transformations should be scientific developments and legal norms that make up the content of the legal institutions like civil service and administrative justice. Taking into account the unfavourable current social conditions in which the above legal institutions function (the conditions of an oligarchic and monopoly state), the common facts of the betrayal of public (state) interests for private-clan interests in the work of the government apparatus, it is proposed to carry out reforming of the above-mentioned institutions by virtue of a new legal category like legal needs covering objectively existing social needs, which are regulated or have to be regulated by legal norms. In order to achieve positive results in the processes of further development of legal institutes of civil service and administrative justice in Ukraine, it is essential to form and implement three groups of constitutional legal needs – general organizational (they are fixed in a general act which regulatory consolidates the foundations of the civilization paradigm and a relevant direction of development), system-organizational legal (they compose the content of the Constitution or fundamental laws) and institutional and organizational (they are fixed in the relevant legislative acts). Based on the priority, legal needs related to civil service and administrative justice are situated in the third group that is quite objectively because there is a high probability to repeat unfortunate mistakes of system reforming that have been being committed over the last 27 years without final definition and consolidation of a new Ukrainian civilization model, which should irrevocably substitute the current practice of an archaic, unpromising oligarchic scheme borrowed from the former metropolis and without a clear determination of the optimal form of the state for Ukraine.
