Protection of terrorism victims: international legal aspect

Abstract

The article analyzes the provisions of international legal acts on countering terrorism in the aspect of protecting the rights of victims of crime; the attention is paid to the United Nations activities and those of its specialized agencies, in particular the Commission on Human Rights, the Counter-Terrorism Implementation Task Force, the Special Rapporteur on the Promotion and Protection of Human Rights in the Fight against Terrorism, and emphasized their contribution to the protection of rights crime victims, as well as to the compensation for damage. Particular attention is paid to the provisions of the 2006 Global Counter-Terrorism Strategy (A/RES/60/288) adopted by the member-states on the protection of human rights and the rule of law in the context of fight against terrorism. It is noted that universal international legal acts in the area of countering terrorism contain the obligation of state to protect and guarantee the right to life, which includes the obligation to take appropriate measures to protect the lives of people under their jurisdiction. The attention was also paid to the activities of international regional organizations and their institutional units in the area of combating terrorism and the protection of the victims of terrorism, in particular, the Organization for Security and Cooperation in Europe, the Council of Europe, and the European Union. In view of the fact that the Council of Europe priority in the fight against terrorism is a commitment to the rule of law and respect for human rights, the provisions of the resolutions and recommendations adopted by the organization in this area are analyzed; the emphasis was placed on the importance of the political decisions taken by the OSCE executive bodies within their mandates, including the Secretariat, the OSCE Office for Democratic Institutions and Human Rights, the OSCE Representative on Freedom of the Media and OSCE field operations; with regard to the European Union, it is pointed out that this organization has repeatedly considered the issue of assistance to victims of crime, in particular within the framework of decisions or directives binding on Member States, but which allow for some flexibility regarding national approaches and practices. Relevant conclusions are made.
