PROTECTION OF THE RIGHTS, FREEDOMS AND INTERESTS OF MILITARY SERVICE AS A MAJOR FUNCTION OF THE MILITARY COURT: ADMINISTRATIVE-LEGAL ANALYSIS

Abstract
The article deals with the possibilities for protecting the rights, freedoms and interests of servicemen as the main function of the military court, analyzes the need for the resumption of the work of the latter after liquidation, the legal and socioeconomic determinants of such a revival. The attention is focused on the fact that in order to restore the violated rights of servicemen and to make a fair and lawful decision, the judge must be professionally trained not only in the field of jurisprudence, but also have knowledge in the military sphere: to know the relationships in the military collective, its traditions, the decision-making procedure by commanders, be able to provide them with an appropriate assessment, etc. which determines the necessary implementation of this specifically by a military court. It is justified that the decision on the serviceman should contribute to strengthening military discipline, raising morale, and not vice versa, and therefore should be lawful fair.
