Публічні консультації як одна з можливих стадій добровільного об’єднання територіальних громад

Abstract
The article examines the issues of public consultations during the voluntary association of territorial communities, regulated by the current legislation of Ukraine. The article notes the primary role of public consultations in voluntary association of territorial communities, including raising awareness of inhabitants about the association of their territorial communities, promoting the exchange of ideas, opinions, and information concerning the complexities of the developed draft decisions that affect inhabitants of territorial communities, and effective influence on final decisions by state and local authorities. The authors demonstrated that today the legal regulation of conducting public consultations on some important issues of local importance is not complex and requires significant improvement at the level of a special legal act. The main attention is paid to the concept of the Draft Law of Ukraine "On Public Consultation" No. 7453. Many positive aspects of this Draft Law are noted, which are in line with international standards and good practice. This includes, in particular, the definition of a wide range of documents subject to public consultation and their detailed explanation (Art. 1); defining a list of principles for ensuring transparency, accessibility and participation, as well as accountability and effectiveness of the consultation process (Art. 4); the requirement for the preparation by the authorities of the generalized information on the proposals received from the results of public consultations (Art. 15), etc. The authors have made comments and suggestions on some of its provisions, including those relating directly to the procedure of voluntary association and accession of territorial communities. It is recommended to expand the subject of regulation and the scope of the drafted Law, and proposed to clarify the content of certain concepts used in it, in particular, such as "a document on state, regional policy and on local issues", "interested parties", "participants of public consultations" and so on. The article focuses on two forms of public consultations defined by the Draft Law: 1) electronic consultations through the publication of a consultation document or a draft act on the official web site of the authority to receive suggestions and comments; 2) public discussion through public events (round tables, hearings, conferences, focus groups, meetings, internet, videoconferences, etc.). As a result of the analysis of certain provisions of the Draft Law, it is concluded that a significant part of issues related to public consultations during the voluntary association of territorial communities remained unregulated or insufficiently regulated by the Project. Therefore, in the Law "On Public Consultations" the authors proposed to regulate in more detail the relevant forms with the aim of legislative unification of local rules for conducting public discussion of the issues of association of territorial communities, currently separately determined by municipal councils.
