Radni odnosi u stečaju-Labour Relations in Bankruptcy

Abstract

Opening of bankruptcy procedure causes numerous consequences that affect the debtor in insolvency and all the persons connected with it. Since employees have the strongest bond with their employer - debtor, special treatment is given to the effect of insolvency on labor contracts. Faith of these contracts in bankruptcy procedure depends upon many factors, but nowadays in majority of countries commencement of bankruptcy does not necessarily mean automatic termination of employment. Since Serbian law has known, during the course of history, both approaches, in this paper we have addressed both of them, and we have pointed out numerous dilemmas that had risen due to imprecise norms. The current Law has accepted more modern concept and sees bankruptcy as a reason for dismissal. However, the Law has not resolved numerous issues that give rise to different interpretations. Danom otvaranja stečajnog postupka nastupaju brojne pravne posledice koje utiču na položaj stečajnog dužnika i svih lica koja su sa njim povezana. Kako su radnici u najtešnjoj vezi sa stečajnim dužnikom, posebno su uređene posledice koje se odnose na tretman njihovih ugovora o radu. U vezi sa pitanjem položaja radnika kod stečajnog dužnika glavna dilema je da li otvaranjem stečajnog postupka automatski prestaje radni odnos, ili je samo reč o razlogu za otkaz ugovora o radu. Sudbina ovih ugovora u stečaju zavisi od mnogo faktora, ali danas u većini zemalјa otvaranje stečajnog postupka ne znači i automatski prestanak radnog odnosa. Kako je pravo Srbije tokom istorije poznavalo oba pristupa, u ovom radu su obrađen i jedan i drugi i ukazano je na brojne dileme koje su nastajale usled nedovolјno preciznih normi. Aktuelni zakon se opredelio za moderniju koncepciju stečaja kao otkaznog razloga, ali nije do kraja razradio brojna pitanja, što daje povoda različitim tumačenjima.
