REGULATORY AND LEGAL SUPPORT OF ADMINISTRATIVE REFORM IN UKRAINE: MAIN STAGES AND PERSPECTIVES

Abstract

With the advent of independence, Ukraine began a new stage in the state-building process. It requires the transformation of authorities affected by the objective reasons. The change lies in destruction of the dictatorial power of the communist government based on an administrativecommand system of management and construction of a democratic state, in which people own all the authority. The changes of the state administration began at the beginning of the formation of statehood. Then the actual task was to search and form a new model of public administration, using the historical development of Ukrainian statehood as well as foreign background. The normative-legal consolidation of administrative reform was important element of the goal, particularly, the establishment of organizational principles of public administration, the definition of principles, methods and forms of public management and administration. The main component of the modernization of public and management activities was establishment and regulation of management activities with the participation of citizens, establishment of their rights and responsibilities in relations with public authorities and guaranteeing of their observance and effective protection in case of violation. With the accordance to the analysis of the part of the normative and legal program documents on the administrative reform in Ukraine, it can be stated that the proposed measures of reforming in the sphere of public administration provide for essentially constructive goals and measures, but most of them are marked by the declarative nature of political will. The actual lack of legal and regulatory control over the implementation of the administrative reform plan has led to a loss of public trust. Today, as never before, there is a problem of integrated solutions for the reform of management activities and its regulatory and legal consolidation, using the principles of legal technology, such as: expediency, timeliness, stability of legislation, control and effectiveness of legal regulation.
