REGULATORY AND LEGAL SUPPORT OF THE PROCESS OF LOCAL GOVERNMENT REFORM AND TERRITORIAL COMMUNITIES: SHORTCOMINGS AND WAYS TO OVERCOME THEM

Abstract
on the basis of analysis of the relevant normative acts, also deficiencies in such support and the development of effective ways to overcome them. At the beginning of the article, there are reasons for the opposition and complications of the process of forming a qualitative, effective and functioning self-government in Ukraine and the formation of capable territorial communi-ties. Further, in the research, to solve these problems and complications, to prevent future legal issues regarding the implementation of planned reforms and reforms in the state, noted the need for clarity in the legal and regulatory sup-port of the reform process, by adopting new legal acts and amending existing ones. In particular, the article deals with the draft law on amendments to the Constitution of Ukraine (regarding decentralization of power), which is the legal basis of all state laws; the relevant Decrees of the President of Ukraine on local self-government reform and changes in the territorial structure of Ukraine are being analyzed; some draft regulations regulating the issues of local self-government reform and the formation of capable territorial communities are described. At the end of the article, general problems of practical and legal character accompanying the process of associa-tion of territorial communities in Ukraine are listed. The main disadvantage in the analyzed normative legal acts was revealed – it the lack of a unified line of strategy and fragmentation of the state policy on the reform of local self-government and the building of capable territorial communities in Ukraine. On the basis of the conducted research, a number of ways to eliminate the deficiencies of regulatory support to the process of reforming local self-government and association of territorial communities are proposed.
