Requirements for administrative court decisions: Polish and Ukrainian experience

Abstract

The purpose of the article is illumination normatively legal regulations of requirements to the court decisions in the administrative legal proceeding of Ukraine and Poland. A scientific novelty consists in to comparatively legal study of institute of court decisions, which has inter-branch character, in the Ukrainian and Polish laws from the administrative legal proceeding. Research pre-condition was become by difficulties and lacks of judicial enforcement, related to quality of court decisions and order of their acceptance. Not correct exposition of positions of parts is noticed 1–3 articles of 242 Codes of the administrative legal proceeding of Ukraine. It is discovered that unlike the Ukrainian law, legality, validity and explained of court decisions of the Polish courts, does not have direct legislative regulation. Such requirements swim out from maintenance of legislative act. Fixing of explained is offered, as requirements to the court decision, in Code of the administrative legal proceeding of Ukraine: decision, accepted a court with aiming of reasons of his acceptance. Author opinion in relation to the general and excellent a sign of institute of court decisions in administrative cases, both in rich in content and norm setting aspects, and expedience of him is expressed normatively improvement. Conclusions. Sum up, that general principles and international standards and achievements of European practice are taken into account and observed the legislator of and Ukraine, and Poland. Polish approach is selected by acceptance of court decision in the administrative legal proceeding in the type of decision, sentence and decision (decision of the Higher administrative court of Poland). The general prospects of both countries are see approaching of the judicial system to consumer need judicial services, in particular, passing (development, improvement) of the legal proceeding to the electronic form, development of internal and external of communication strategy, in fact the use of electronic services in the legal proceeding is a modern public query in all states.
