Abstract
The problems of rule of law, which take place at the beginning of the pre-trial investigation of obtaining illegal benefit by an official person, that is begun by the materials of operative subdivisions of the National Police are determined. The ways of solving these problems are proposed. The propositions concerning the improving of the operative-search and criminal procedure law are given.
