SEPARATE ASPECTS OF REALIZATION OF THE RIGHT TO A FAIR TRIAL OF CASES IN THE FIELD OF SOCIAL PROTECTION

Abstract
The article analyzes the issue of implementation of right to fair trial of cases in the sphere of social protection. The attention that the release of the government departments, in particular, the Pension Fund of Ukraine, from the payment of the court fee, gives them the opportunity to appeal against court decisions which have come into force. Attention is drawn to the fact that in such cases the courts recovery timing to appeal court decisions that have entered into force, is one of the violations of the right to a fair trial. It was analyzed the arbitrage practice on this issue, in particular the practice of the European Court of Human Rights.
