SEPARATE QUESTIONS OF DETERMINATION AND CHANGE OF MAINTENANCE OF LABOUR CONTRACT

Abstract
Problem setting. In the article the analysed questions which are related to the central institute of labour right – labour contract. Without this legal phenomenon it is actually impossible to present a labour right as industry and, accordingly, science of labour right. An author accented attention on the separate questions of determination and change of maintenance of labour contract. A labour contract is the central institute of labour right. Without this legal phenomenon it is actually impossible to present a labour right as industry and, accordingly, science of labour right. In the process of conclusion, change of maintenance, dissolutions of labour contract arise up numeral questions which without the proper recommendations of research workers to decide difficultly. Target of research. A purpose of this work is general research and analysis of legal problems of determination and change of maintenance of labour contract. For achievement of this purpose it is necessary to decide such tasks: 1) to give determination a concept labour contract; 2) to probe requirement to maintenance of labour contract in a legislation; 3) to find out essence of such legal phenomenon, as a separate agreement. Analysis of resent researches and publications. Many research workers spared attention the questions of determination of maintenance of labour contract in the fields of labour law, among which it follows to name, in the first turn, K. Abzhanov, E. Scientific labours of the adopted authors did not lose the value and until now. Conclusions and prospects for the development. Thus, position of part of the first article of 64 projects of the Labour code, which prepares to the second reading, in which an exhaustive rank is set two types of changes of conditions of the labour agreement only, answers neither the requirements of practice nor level of development of question of maintenance of labour contract, in theoretical researches.
