СИСТЕМА ГАРАНТІЙ ДЕРЖАВИ ЯК СУБ’ЄКТА ПРАВА СОЦІАЛЬНОГО ЗАБЕЗПЕЧЕННЯ

Abstract
The article examines the system of guarantees of the state as a subject of social security law. The legislation of Ukraine is analyzed. It is emphasized that the guarantee of social protection is provided by the compulsory state social insurance at the expense of insurance premiums of citizens, enterprises, institutions and organizations, as well as budget and other sources of social security, and one of the forms of social security is pension provision. It is determined that social and economic guarantees are: a) a guarantee of social security at the expense of insurance premiums of citizens, enterprises, institutions and organizations, as well as budget and other sources of social security in the case of full, partial or temporary disability, loss of breadwinner, unemployment from independent from them circumstances and in other cases stipulated by law; b) guarantee of pensions, other types of social benefits and benefits that are the main source of living and ensure a standard of living that is not lower than the subsistence minimum. It is emphasized that the guarantee of the minimum wage, as a guarantee of the state as a social security provider, consists in the fact that the state, for the purpose of social protection of citizens, establishes the minimum possible wages that are sufficient to meet basic needs. It is concluded that the system of guarantees of the state as a subject of social security law is made up of: social and economic guarantees (a set of economic and social means that provide conditions for meeting the needs of social security providers); political guarantees (a set of means that guarantee the person’s ability to participate in the political life of the state, and their activities contribute to social security of the poor population categories); organizational guarantees (a set of institutional and legal means designed to organize social security of the population).
