Abstract
The content rights and duties of the subject of criminal procedural relations, the investigator, concerning the release from criminal liability there investigated. The necessity, based on the analysis of the current and previous legislation, improvement of the criminal procedural legislation, regarding the issues of realization of the rights and duties of the investigator in the process of exemption from criminal liability, was determined. It as proved that the expediency of assigning the investigator the right, in agreement with the prosecutor, to apply to the court for the release of the person from criminal liability and the introduction of appropriate changes in the norms of the Criminal Procedure Code of Ukraine.
