SOME PROBLEMS OF LEGAL REGULATION OF CRIMINAL PROCEEDING RELATIONS IN THE CRIMINAL PROCESSUAL CODE OF UKRAINE

Abstract
With the entry into force in November 20, 2012, the Criminal Procedural Code of Ukraine marked the fulfillment of the requirements and desire of Ukraine as an independent state that is continuously and steadily moving towards integration into the legal framework of the European Union. Unfortunately, despite the adoption of the new Criminal Procedural Code of Ukraine, he has already needed many changes, amendments and improvements. It should be noted that the legislator’s position regarding the protection of rights and legal intuitions not only the accused (suspect, defendant), but also the victim was considerably reformed. Therefore, it is also important today to carry out scientific research aimed at improving the provisions of the Criminal Procedure Code of Ukraine in order to ensure and maintain the proper legal regulation of criminal procedural legal relations, which as a result will provide adequate protection of the rights and freedoms of the subjects involved in criminal proceedings. Under these conditions, there is an unconditional need for writing scientific articles for conducting research and analyzing problems in the legislation and making proposals for their solution. The relevant article is intended to investigate legal regulation issues contained in the criminal procedural law on such legal institutions as the representative of the probation body, the victim, the legal representative, the preparatory court session, journal court hearing, pretrial-report etc. According to the results of the analysis, the article proposes the possible options and ways of solving these inconsistencies in legal regulation.
