SYSTEM OF SPECIALLY AUTHORIZED SUBJECTS FOR CORRUPTION PREVENTION: MODERN STATE AND COURSES OF FURTHER DEVELOPMENT

Abstract

The article analyzes the current state and defined directions of further development of the system of specially authorized persons to counteract corruption in Ukraine. It is stressed that the prevention and counteraction of corruption in Ukraine is a task that has been set before all the institutions of the state, civil society. It is determined that the security and defense sector of Ukraine consists of four interconnected components: security forces; the forces of defense; defense industrial complex; citizens and public associations that voluntarily participate in ensuring national security as a defense of state sovereignty, territorial integrity, democratic constitutional system and other national interests of Ukraine from real and potential threats. It is noted that newly created institutions in the infrastructure of anti-corruption reform include NABU, specialized anti-corruption prosecutor's office, NACC, the National Agency for the Detection, Investigation and Asset Management of Corruption and Other Crimes, the State Investigation Bureau, the Specialized Anti-Corruption Court. Attention is drawn to the existence of a conflict between the norms of the special legislation in the field of prevention of corruption on the list of subjects specifically authorized to fight corruption and the status of those bodies not included in the list, defined in art. 1 of the Law of Ukraine “On Prevention of Corruption” of 14.10.2014 № 1700-VII, but still have in their competence powers to counteract the negative phenomenon. Conclusion is made on the necessity of urgent reformation of the SBU status, the relevant legislation. Notwithstanding the deprivation status of the SBU as a specially authorized entity for combating corruption, the organizational and legal basis for the interaction of the service in the field of counteraction and prevention of corruption with other entities that perform the specified tasks should remain among the bases of its functioning.
