THE ADMINISTRATIVE-LEGAL STATUS OF A DISTRICT MILITIA INSPECTOR’S PUBLIC ASSISTANT

Abstract

The article deals with the analysis of administrative-legal status of a district militia inspector’s public assistant as the subject of law enforcement. The activities of district inspectors of militia for the operation of public assistants is governed by applicable laws and departmental normative legal acts. The analysis of these documents provisions suggests the presence of certain problems in the legal maintenance of their joint activities. The study of the concept of "regulatory status" in administrative law doctrine has formulated the definition of the concept "a district militia inspector’s public assistant" who is an adult with the citizenship of Ukraine, contracted by a district inspector of militia at his own will, on a voluntary basis in the manner prescribed by the legislation. The authors have analyzed the normative legal acts that determine the administrative-legal status of a district militia inspector’s public assistant. Such basic elements of this status as rights, duties and responsibility have been studied. The authors have proposed a number of changes to existing legislation regarding the improvement of administrative and legal status of a district militia inspector’s public assistant. It is proposed to legislate the right of a district militia inspector’s public assistant to compose protocols on administrative offenses on separate corpus delicts. The list of duties of a district militia inspector’s public assistant, which also needs appropriate legal fixation has been specified. The authors have concluded that current regulatory legal acts on the whole define the elements of the administrative-legal status of a district militia inspector’s public assistant; however, they need to be improved through specification of some individual provisions.
