THE APPLICATION OF FUNCTIONAL INTERPRETATION IN THE INTERPRETATION OF THE PROVISIONS OF THE POLISH ACT ON ACQUISITION OF REAL ESTATE BY FOREIGNERS OF 24 MARCH 1920

Abstract
Pursuant to the Polish Act on Acquisition of Real Estate by Foreigners of 24 March 1920, a permit of the Minister of the Interior is required in order for a foreigner to acquire ownership rights or perpetual usufruct rights to real estate. Acquiring a real property against the regulations is null and void. No permit of the Minister of the Interior and Administration is required to acquire ownership rights to residential premises. Under the functional interpretation, one may assume that no permit is required to acquire a share in a real property that is used, for example, as the access road because a share in that real property is indispensable for the buyer. Such an interpretation of the regulations does not lead to conclusions that are in conflict with the rules of logical reasoning, and it is also justified by the purposes of the aforementioned statute. The judicature permits the use of functional interpretation if there are any doubts concerning statutory law.<br/><br/>
