THE BASES OF OCCURENCE OF DELICTUAL OBLIGATIONS IN CIVIL LAW OF UKRAINE AND THE USA

Abstract
In the article the analysis of basic provisions of civil law of Ukraine and the USA about the bases of occurrence of delictual obligations is carried out. As in civil law of both countries the concept of the delictual obligation is connected with a concept of the tort liability, the correlation of the specified concepts is defined. There are studied the legal facts, on the basis of which delictual obligations occur. There are revealed the features of occurrence of separate types of delictual obligations caused by the fact that in the USA, along with existence of a system of singular delicts, the legislation of separate states establishes also the general norms which can be applied to any civil offense.
