THE CURRENT STATE OF LEGAL REGULATION OF PRODUCTION AND TURNOVER OF VODKA PRODUCTS IN UKRAINE

Abstract
Problem setting. Legal regulation of the activity of enterprises related to production and turnover of vodka beverages should coordinate several complicated tasks: pumping up the budget; preservation of physical and spiritual health of the nation; protection of the population from consumption of bad-quality products, etc. Recent research and publications analysis. Nevertheless, dynamic development of production and turnover of alcoholic and low-alcoholic beverages causes a need for new legal approaches. Paper objective. The article objective is to analyze the current state of the legal regulation of the economic activity related to production and turnover of alcoholic products in Ukraine and to indicate tendencies concerning the further regulation and development of this branch. Paper main body. Taking into account the situation of increasing alcoholism in Ukraine and the statistics of the law-enforcement bodies, the local self-governing bodies must facilitate achievement of the balance of interests of the entrepreneurs and the population in this area in order to eliminate disturbance of public peace and to conduce to a healthy way of life. Amending the Law of Ukraine «On Public Regulation of Production and Turnover of Ethyl, Cognac, and Fruit Alcohol, Alcoholic Beverages, and Tobacco Products» would be one of regulation methods. These amendments should consist in setting stringent requirements for places of trade of alcoholic, law-alcoholic beverages, and beer and imposing prohibition on selling the mentioned product groups at temporary structures. Conclusions of the research. There are four key legal instruments, which considerably affect processes of selling alcoholic beverages as a type of the economic activity: normative defining a scale of a concept «alcoholic beverages»; license requirements, which determine the regime of entering a corresponding market; an extent of division of governmental body powers aimed at regulation of alcoholic beverages turnover; taxation of alcoholic beverages, which should take into consideration the adequacy of tax and excise rates.
