The discretionary power of the administrative authority

Abstract
The article discusses the differences and similarities between discretionalism of judicial power and administrative authority. It points to a possible distinction between administrative discretion and discretionary power, mainly to assign the final decision of law`s application to the free-made decision and the reasonings of interpretation to the discretionary power. The author also considers the possible risks in a democratic state of law relating to abuse of administrative authority qualities of discretion.
