THE HARMONIZATION OF THE ROMANIAN ARCHIVE LEGISLATION WITH THE EUROPEAN ONE, AND THE TRAINING OF ARCHIVE STAFF

Abstract
After 1989, the profound changes occurred in the Romanian society and in Eastern and Central Europe provoked a growing interest for archives in the context of the new challenges. Legislation plays a special part in development of the archive domain. Actual legislation in Romania, especially Law no. 16 from 1996 has only 38 articles and eliminates many of the former dispositions due to the fact that after 1989 many structures and many organizations have disappeared. From a legislative point of view, it can be observed an acute lack of adjustment to the social demands. Legislation should be adapted to the actual economic and social aspects in Romania. This year, a new archives law, regarding archive practice’ reorganization and modernization, should appear. Recommendation No. R (2000) 13 of the Committee of Ministers to Member States on a European Policy on Access to Archives has distinguished as an European pattern. On the 13th of July 2000, has been created the first and the only intra-governmental pattern regarding the practice and the policy of archives in Europe. Designed in collaboration with the International Archive Council and with the Open Society Archives (OSA), this “guide” is a result of co-operation between national archive authorities, researchers, scholars, NGO-s from the 48th state members of the European Cultural Convention of the Council of Europe.
