The impact of the Monroe Doctrine on international law

Abstract

This article explores the problem of the impact of the Political Monroe Doctrine on International Law. It shows the development of regional international law on American continent. The author given examples of regional act of the international law, formed under the influence of the studied doctrine. It analysis of the political aspects of process of formation of the international law. The main content of the doctrine was the declaration of the two parts of the Americas continent, as closed to European colonization. The Monroe Doctrine consists of two principles. There are two principles of the studied doctrine: “principle of non-intervention in the affairs of states” and “principle of non-colonization”. The author researches how the principles of the Monroe Doctrine found its way under international law. The Monroe Doctrine has made a significant impact on the formation of the principles of international law as the principle of non-intervention, and the principle of decolonization States. Thesis and principles of the political Monroe Doctrine were transformed into the universal international legal norms to the prohibition of any intervention, prohibition of interference in the internal or external affairs of states, and the prohibition of any colonization of states. The author points to the problem of effective international legal mechanism of ensure the implementation of international legal norms, formed under the influence of the studied doctrine.
