The Internally Displaced Persons’ Right to Education in Ukraine: Legal Provisions and Problems of Realization

Abstract

Due to the military conflict in the territory of Ukraine, which was caused by the Crimea and Donbas occupation by militants, persons who moved from the occupied territories cannot exercise the right to education, which was guaranteed by the Constitution of Ukraine. According to the laws of Ukraine every person has the right to qualitative and accessible education. The right to education includes the right to education throughout life, the right to accessible education, the right to free education in cases and in the manner prescribed by the Constitution and laws of Ukraine. Today Ukraine has equal opportunities for everyone. No one can be limited to realising the right to education. The right to education is guaranteed regardless of age, gender, race, state of health, disability, nationality, ethnic origin, political, religious or other views, place of residence, language, origin, social and financial status, convictions, etc. But unfortunately, the majority of internally displaced persons who were forced to move to the protected territories have difficulties accessing pre-school, secondary and higher education which should be provided by the state. This article analyses and considers the problems of implementing the internally displaced persons’ right to education in Ukraine. The urgency of the topic is related to the fact that it is the realization of the right to education that the normal functioning of a democratic state depends on. Implementation of the law on education among internally displaced persons is a particularly important issue since education is essential for every person. It is necessary that the legislation provides for the effective realization of the right to education through which internally displaced persons can receive pre-school, secondary and higher education.
