The Legal System Governing Public and Private Sectors in the Economy of Iran

Abstract
Today, economics and law are so interdependent and interactive that it cannot be easily ignored. Today's jurists, on the one hand, endeavor to analyze law using economic instruments, and on the other hand through providing new laws, they are trying to help improve people's welfare and promote better economic prosperity and economic development of their respective country. Therefore, the exact identification of the legal status of the economic structures of the communities and the explanation of the position of the economy in the thoughts of the lawyers of each country is of great and increasing importance. Consequently in this research, we are trying to describe the dominant legal status in the economy of Iran and according to the internal laws and regulations of Iran, analyze the status of the different sectors of the state economy, private and cooperative, as well as the privatization process that is nowadays considered as an inevitable way in the communities. By studying the domestic legal system, it has been observed that before the drafting of the provisions of Article 44, the domestic law approach to the issue of economy has been state-based, but gradually by reforming the law and the efforts of the legislator in the formulation of new regulations, this condition has been improved. The domestic legislator, through understanding that the privatization process is one of the principles of governance, has tried to promote the status of the cooperative sector and the private sector in the economic affairs of the country. For this purpose, several supervisory institutions have been considered. These institutions in addition to supervising the performance of the public sector in the exercise of its jurisdiction in this area, will also more precisely monitor the process of transferring affairs to the economic sector. In this study, while reviewing the rules and regulations related to different economic sectors of Iran's law, we will also introduce and analyze the organizations that supervise these sectors.
