THE NORMATIVE AND LEGAL STANDARDS OF REGULATING LABOR RELATIONS WITHIN THE FIELD OF SCIENTIFIC AND RESEARCH ACTIVITIES UNDER THE PRESENT LEGISLATION OF THE SOCIALIST REPUBLIC OF VIETNAM

Abstract
In the paper the author considers and analyzes the normative and legal standards of regulating la- bor relations taking place within the field of scientific and research activities in compliance with active Law on Science and Technology of the Socialist Republic of Vietnam. The author adduces concrete legal norms of the given Law establishing and regulating the legal status of the scientific and technology worker as a full rights subject of labor relations institution. Based on the example of the Law the author also proves determined character of simultaneous, more precisely inter-branch assignment of the field of scientific and research activities both purely to labor law system and edu- cation, science and culture law system that characterizes not only international, but also national law of a country being taken separately. It is concluded that the legal provisions of the Law of the Socialist Republic of Vietnam "on activities in the field of science and technology" fully reflect the nature of membership as labor law and other legal areas, in particular the right to education, science and culture, and intellectual property rights. This law confirms the designated international industry experience and legal norms example of con- tent sources of law in the research activities of a single country, but it indicating and vibrant demo- cratic mechanisms and cross-border participation in activities related to the development of science and technology in Vietnam.
