THE PHENOMENON OF LOSING BY THE LAW AND SLAUGH TER FREEDOM OF CONTRACT: COMPARATIVE AND LEGAL ANALYSIS

Abstract
The article investigates the legal nature of abuse of the law and abuse of the freedom of contract. Their definitions and key features are given. The actual definition of abuse of the right and abuse of the freedom of contract is formulated, as well as the author’s vision of the essential features of these civil law institutions is indicated. The emphasis is on intentional and illegal actions aimed at abuse of the law or abuse of freedom of contract. A comparative analysis of the above-mentioned categories is carried out and their relationship with each other is clarified.
