THE PROBLEM OF DETERMINING THE INITIAL MOMENT OF HUMAN LIFE AND ITS IMPLICATIONS FOR CRIMINAL AND MEDICAL LAW

Abstract
The article deals with important and controversial in the science of criminal law, and in medicine the determination of the initial moment of human life. The reason for the problematic of this issue is the fact that both processes of birth and dying, is quite long, thus giving rise to different points of view of scientists, as in law and medicine. Studied the works of Russian scientists that were involved in the development of this issue. Was studied the theoretical principles relative to the initial moment of human life and identifies the significance of the initial moment of human life for the criminal and medical law. In the result of the study was made separate proposals to improve legislation of Ukraine in the sphere of protection of the human right to life.
