THE PROBLEM OF UNDERSTANDING THE BASIC LAW OF WAR IN MODERN PHILOSOPHY OF WAR

Abstract
The article reveals the essence of the basic law of war. It is shown that in today’s changed ratio of political-diplomatic, economic, information and military means political purposes. Political-diplomatic, economic, informational forms of struggle have become more targeted and coordinated nature of increased scale. Under these conditions the question is updated to reflect the fundamental law of war in the context of rethinking the nature of war in the modern world. It is noted that all laws relating to the conduct of warfare, are divided into two groups – a system of laws of war and armed struggle. The Basic Law defines addiction war course and outcome of the war by political objectives and by the balance of forces warring parties. It is emphasized that most of the laws of war and armed struggle are formed as logical generalization considerable experience of war, accumulated by mankind. However, the nature of war, forms and methods of warfare today as rapidly changing qualitatively that the experience of recent wars lacking for predicting future patterns of war. Thus, to form the laws of war and armed struggle of the future must be sufficiently reliable theoretical basis. A basic law considered war as a model adequate to the real course of the war, covers a wide range of factors and conditions while not losing its constructiveness. Regardless of the structure of the subject of political relations and economic development, and used them as means of armed struggle in the overall system of political relations including (in the transition system in a state of war, can be defined: first – the presence of purpose to each sub ’object of political relations and to its structural elements, and secondly – the goal of lower rank follows from goal higher. Thus, the political goal was not achieved through peaceful means, determines the setting of causing to the armed forces. The choice of objectives War (military objectives) affects nature of tasks solved the structural elements of the armed forces during military operations, etc., in the third – the goal of lower level sets the goal of a higher grade. The findings indicate that knowledge of basic law of war affect the direction of development of military science, the formation of the purpose and nature of military research makes it possible to scientifically approach the elucidation of unity, differences and interactions whole range of policy tools, including the use of armed vehicles violence and military force in resolving political goals. With a view to understanding the essence of «not fighting» confrontation forms the basic law of war can be applied as: the progress and outcome of the war depends on the objective nature of the policy objectives of compliance with these policy objectives, and to match the real situation military purposes, forms, techniques and methods of modern warfare. The above wording suggests that the methodology of forming the laws of war and armed struggle requires a further improvement
