THE RIGHT TO CHOOSE THE EMPLOYEES: THE REGULATORY FRAMEWORK AND THE GROUNDS FOR THE RESTRICTION OF IMPLEMENTATION

Abstract

The article is devoted to the research of normative foundations and the content of the employer’s right to select em- ployees. The main restrictions on the employer’s right to freely select employees are analyzed. The essence of groundless refuse is certain in a reception on work, its correlation with discrimination at employment. Particular attention is paid to the analysis of testing as a form of professional selection. Proposals for the improvement of labour legislation and the draft Labour Code of Ukraine have been made.
