The Territorial Historical Right of the State and the Legal Inequality in the Relations between Croatia and Byzantine Empire (800–1102)
Journal Title: Правові новели - Year 2018, Vol 4, Issue
Abstract
The process of formation of the medieval Croatian state (819–1102) became the product of certain conditions of the european history. Its fall was also dictated by external factors. Accordingly, the purpose of our article is to explain the legal nature of these external historical factors. Relying on a wide range of sources, we consider it necessary to emphasize that the “royal title” of the ruler in medieval Europe was not a pledge of the legal subjectness (legal status) of his country. The king could well have been the vassal of the emperor. For example, Croatian kings, from the point of view of medieval law, were subordinate to the Byzantine emperor. The recognition by the Byzantine emperor Roman I Lakapin (920–944) the royal title of Tomislav the Great (910–928) confirms our thesis.
