THE UNDERSTANDING OF THE PENALTY IN THE ANTIC GREECE LEGAL THOUGHT

Abstract
The article shows the understanding of penalty in Ancient Greece on the basis of antic philosophers’ works, law memorandums, history and legal science insights. It is shown that penalty had sacral character and antic philosophers recognized it as an instrument or as a mean of “purification” of the offender, retribution for committed sins, rectification of an injustice. Punishment and retribution had no strict division in the law and conscience of Early Greeks and these notions were commonly identified. Is made the conclusion that by the penalty in Ancient Greece were meant some coercive measures of polis public authorities against violator of set law and order, which were the result of committed crime. The aim of the penalty was horrification, the desire to avoid in future unfavorable and dangerous for citizens, society and state deeds.
