THE ZEMSKY BANK OF THE KHERSON PROVINCE AS A SPECIFIC FORM OF CREDIT COOPERATION OF UKRAINE IN THE SECOND HALF OF THE 19TH AND EARLY 20th CENTURIES

Abstract
The Zemsky bank of the Kherson province as a specific form of credit cooperation of Ukraine in the second half of the 19th and early 20th centuries. The article analyses the organizational and legal principles of functioning of such a unique partnership as the Zemsky Bank of the Kherson province – one of the first mortgage institutions of the Dnieper Ukraine and the Russian Empire in general, which arose after the abolition of serfdom in 1861. Under pressure of the circumstances of the economic nature the board, the supervisory board and the general meeting of members of this company, which was under the direct control of the Ministry of Finance, from time to time amended its Statute. However, they concerned mostly management systems, while the rights and obligations of customers remained unchanged, not keeping in mind the term for which they could receive loans. The peculiarity of the Zemsky Bank of the Kherson province was that it was not a classic credit company, which in the Russian Empire functioned on the basis of the model statute of 1895. At the same time, it was not a classic joint-stock land bank, which issued loans secured by any land, not just large land tenure. There were other features of this mortgage institution, which are discussed in this publication. At the current stage of reforming the economy of Ukraine, the issue of activities of banks and other lending institutions remains very relevant at least for two reasons. Firstly, further improvement is needed not only in the activities of banks but also in the legal framework for their functioning, in particular, the provision of one of the important components of a market economy – the formation of land banks. Secondly, until now, the experience of the domestic credit system, which developed in Ukraine after the abolition of serfdom in 1861 and the introduction of other reforms in the 60s of the XIX, was not fully taken into account. The role of these plots in shaping the classical economy of the European type becomes more understandable, bearing in mind that at the end of the XIX century Russian legislation created favourable conditions for the development of a credit system based on the best foreign models.
