Томос для Української Православної церкви: правові перспективи та попередній канонічно-правовий аналіз становища сторін / Thomos for Ukrainian Orthodox Church: Legal Prospects and Preliminary Canonic Law Analysis of the Parties’ Grounds

Abstract
The article analyses the canons of the Ecumenical Councils regulating the provision of autocephaly and the change in subordination of the eparchial territories from one patriarch to another, which might be useful in the resolution of the dispute between Moscow and Constantinople Patriarchs regarding the status of Ukrainian Orthodox Church and granting it autocephaly. Moscow Patriarchy position is grounded on the canons prohibiting alienation of the subordinated eparchies without permission of the hierarch, whose territories are affected and on the historical subordination of Ukrainian eparchies to Moscow Patriarchy. Position of the Patriarchy of Constantinople is based on the exceptions, certain canonical precedents and doctrinal principles of the Church. Such exceptions include the case of the outside hierarch mending schism or heresy on the territory of another hierarch who was not able to do it himself. This is exactly the case in Ukraine where the Ukrainian Orthodox Church of Kyiv Patriarchate is outside of canonical communication but is ready to reconcile to the Patriarch of Constantinople and to obtain autocephaly thomos from the latter. First doctrinal principle applied is the right of the laics to take part in determining the Church’s organization and fate, which is realized in Ukrainian case by the way of majority orthodox believers joining the Patriarchy of Kyiv. Another doctrinal pillar is the duty of the Church to respect the state powers, which is the consequence of the theological concept of the state origin and the 6th Novel by Justinian. In Ukrainian case this ground is realized through the request from the President and the Supreme Rada of Ukraine to the Patriarch of Constantinople to accept the Patriarchy of Kyiv to communication, subordinate its territories to the Ecumenical Patriarchy and grant it autocephaly. The article also depicts potential problems which Ukrainian Orthodox Church might face as a result of obtaining the autocephaly status of the exarchate of the Patriarchy of Constantinople.
