Abstract
The article is devoted to solving the problems of criminal-law assessment of the extortion ofun law full benefits with the use of discretionary powers of the subject of “passive bribery”. It was concluded that such an assessment of the focus of accent is not on the legality of the behavior of the special subject of extortion, but on its legitimacy and legality of the rights and interests of the person who is forced to promise, offeror give unlawful benefit and endanger the violation in the event of the use of a special subject of their discretionary powers.
