ACTIVE REPENTANCE IN THE CRIMINAL LAW SYSTEMS OF POST-SOVIET COUNTRIES

Abstract

The article deals with the issues of legal regulation of active repentance in the criminal legislation of post-Soviet countries. Considerable attention is paid to the analysis of the criminal legal consequences of active repentance, in particular, to its role as the grounds for the release from criminal liability, as a mitigating circumstance, as to application of special rules for imposition of a punishment and release from punishment, to its importance in creating special types of exemption from criminal liability for certain crimes provided for in the Special Part of the Criminal Code. Both common approaches and specific features of the legal regulation of active repentance in the post-Soviet countries have been analyzed. Based on the research and taking into account the experience of foreign countries, proposals as to possible ways of improvement of the criminal legislation of Ukraine have been formulated.
