Аналіз проміжних результатів реформи системи місцевого самоврядування в Україні та викликів її продовження

Abstract

The article is devoted to the analysis of the results of the first steps of the implementation of the local self-government reform in Ukraine after 2014, aimed at implementing the idea of decentralization of public authority in Ukraine. This research is part of the research collaboration between two centers: the Ivan Franko National University of Lviv (Ukraine) and Academy n.a. Yana Dlugosha in Czestochowa (Poland). The history of the development of the structure of local self-government in Ukraine is relatively recent and begins with the proclamation of Ukraine's independence in 1991. The previous soviet government system, although it provided for the existence of an extensive network of local councils of people's deputies, did not fulfill the functions of implementing the right to self-government. The system of local self-government bodies in Ukraine, which has been formed since 1997, did not fulfill its task, remaining a derivative (both in functional and in material and organizational sense) of the system of state administration. The reform of decentralization of public administration is aimed at building an effective system of territorial organization of power in Ukraine by implementing the principles of subsidiarity, universality and financial self-sufficiency of local self-government. The main directions of the reform should be considered: - formation and definition of capable communities as a primary unit of government and administrative system, - the transfer of functions which, on the principle of subsidiarity, should be implemented locally; - the elimination of dualism at the regional level, through the creation of executive agency of oblast and rayon councils, the reorganization of local state administrations as local executive agency and the replacement of them with the prefectural institute with control and supervisory and advisory functions to ensure the implementation of local self-government. The need for community unification is due to the lack of sufficient conditions for the real ability of small communities to effectively carry out their tasks, while consolidation leads to the creation of additional financial and material potential within the association's activities. In the process of reform, the district («rayon») level should be attributed to optional, and not mandatory levels of local self-government. With the further completion of the unification and creation of capable territorial communities, it will be possible to abandon it at all, and the tasks that today are carried out by districts authorities will become the subject of voluntary cooperation of territorial communities. The districts will remain part of the administrative-territorial system without independent agency of government. In the process of reforming the system of public administration at the local level, Ukraine can take advantage of the successful experience of Germany and Poland in organizing a system of local self-government. In the processes of decentralization in Ukraine, international programs are widely used and important, such as, for example, «Decentralization Offering Better Results and Efficiency (DOBRE)». It is also important to establish an independent institution for monitoring the legality of the activities of local government organs, such as the Supreme and Regional Chambers of Control, which operate in Poland.
