AUTHORITY OF ADMINISTRATIVE COURTS, WHERE ADMINISTRATIVE LIABILITY IS A SUBJECT OF POWER

Abstract

The article deals with the competence of the Administrative Court of Ukraine, the main part deals with the main issues and concepts of the Administrative Court and the subject of power, reviews the regulatory as well as the problematic issues on this topic. The Administrative Court is a judicial authority empowered to administer justice in administrative matters by resolution of cases of administrative jurisdiction (public law disputes). The regulatory framework of the legal status and activity of administrative courts is the Constitution of Ukraine, laws of Ukraine on the judicial system, the Code of Administrative Justice of Ukraine, and the regulations adopted for their implementation by subordinate legal acts. The emphasis is made on problematic issues in resolving disputes, in which the party of power is a party to the plaintiff. Accordingly, the subject of authority is the authority of the government, local governments, their officials or officials of other subjects in the exercise of their duties on the basis of legislation, including the delegated powers endowed with a set of rights and the duties of state bodies and public organizations, as well as officials and other persons entrusted to them in accordance with the procedure established by law for the exercise of their functions. Peculiarities of disputes between the subjects of power over the implementation of their competence in the field of management, including delegated authority. Peculiarities of disputes regarding the acceptance of citizens for public service, its passing, dismissal from public service. The issue of competence disputes is also considered. Disputes of competence refer to disputes between public authorities on the implementation of their competence in management (public administration), including delegated powers.
