BASIC FOLDS IN THE LAW ON SEA PORTS

Abstract
The paper refers to the basic provisions in project of law on sea ports. The project presently undergoes normal legislation procedure. It realized a division, accepted in law's provision, into management and operation spheres. In course of the accepted provision, a stock company is a managing subject of public utility and non-profit character - and design all profits (including the State Treasury subsidies) on development of new port infrastructure. In turn, the subjects acting in operation sphere of ports base their activities on fully marketing conditions (aiming at profit). Thus the law draft tends to stimulation of market mechanisms in Polish ports, but it still provide some mechanisms resisting monopolisation process in operation activities. The proposed solutions are in accordance with the European Union law, moreover it correspond with the modern legislation.
