[b]Registration of the Industrial Property Rights in the Polish Law[/b]

Abstract
Registration of the industrial property rights has never been sufficiently explored in the Polish legal doctrine. However, due to an obligation of registration, it has become necessary to present particular stages of the process of registration of each of the industrial property rights. Apart from presenting the procedure of registration of IP rights, the author considers the differences between the concepts of “the right in registration” and “the right of protection”. These considerations, contrary to postulates formulated in the doctrine, lead to a conclusion that the standardization of the concepts used in the Industrial Property Law Act is not justified. Those considerations are also aimed to present the differences between registered and not registered property rights and to answer the question as to whether the registration of industrial property rights prevents economic operators from entering the market.
