CONSTITUTIONAL REGULATION OF THE PROCESS OF AMENDING THE BASIC LAW OF UKRAINE AND THE CONSTITUTIONS OF CERTAIN POST-SOVIET STATES (COMPARATIVE LEGAL ASPECT)

Abstract
The purpose of this article is to determine general and distinctive features of the constitutional regulation of amending the fundamental law of the state in Ukraine and in some post-soviet countries. Based on the comparative analysis of the constitutions of Ukraine, the Republic of Belarus, the Republic of Lithuania, the Republic of Kazakhstan, Georgia and the Russian Federation, the general and distinctive features of the constitutional regulation of the procedure of amending the fundamental law of the state have been defined: 1) subjects authorized to initiate amendments in the fundamental law of the state; 2) forms of direct participation of citizens in the procedure of constitutional lawmaking; 3) bodies authorized to exercise control over the constitutionality of amending the fundamental law of the state; 4) issues on which amendments to the constitution are not allowed; 5) legal facts or conditions preventing amendments to the fundamental law of the state; 6) subjects authorized to make decisions on amending the constitution. The author has reasoned the necessity of making amendments to the Constitution of Ukraine, namely in part 2 of art. 7, and has proposed its own edition.
