CONSTITUTIONAL RIGHT TO ASSOCIATION IN PROFESSIONAL UNITS: LEGAL REGULATION IN THE CONTEXT OF THE FOREIGN EXPERIENCE

Abstract
The article deals with the problems of legal regulation that arise in the process of implementing the constitutional right to unite in trade unions in Ukraine. A comprehensive analysis of the constitutional principles of the functioning of trade unions both in Ukraine and in foreign countries is carried out, as today there is an urgent need to strengthen the role of trade unions as a social partnership institution and, as foreign experience shows, it is the trade unions that can prevent or at least mitigate the resolution of social conflicts, and the contradictions that arise between workers, employers and the state. Constitutional right to association of citizens including in unionization and its effective implementation is an important condition for the formation of a civil society and the formation of an institution of social partnership. As a number of other associations of civil society, trade unions exercise their activities based on the interests of a certain group of people, which is distinguished in society in accordance with the exercise of professional activities. Effective implementation of the constitutional right of citizens to unite in the union and its effective functioning, primarily depends on the state of society, the state of the trade union movement and the state of socio-economic policy of the state. Attention is drawn to the fact that the foreign experience of the activities of trade unions proves that they can function as full members of social relations and play the role of an important social regulator. In Ukraine today, the effectiveness of social partnership and the role of trade unions in this process have been substantially reduced. First of all, this is conditioned by a number of factors, firstly, the complexity and ambiguity of the relationship between trade unions and employers; secondly, a decrease in the trust in the institute of trade unions among the employees and the reluctance of the latter to actively participate in their activities; thirdly, the imperfection of the legal regulation of the activities of trade unions; fourthly, low level of economic development; fifth, high unemployment and labor migration. The study concludes that for today there is a need to strengthen the role of trade unions as an institution of social partnership, as international experience shows that trade unions are capable of preventing or at least mitigating the social conflicts and contradictions that arise between workers, employers and the state. It is noted that the effective functioning of the Institute of Trade Unions can have a significant impact not only on protecting the socio-economic rights of employees in the process of interaction with employers, but also on influencing public power in order to optimize the implementation of social policy at the national level.
