CRITERIA FOR RECOGNITION OF THE STATUS OF THE AUTHORIZED ECONOMIC OPERATOR: THE EUROPEAN EXPERIENCE

Abstract

In this paper, the European experience of practical application of the provisions of the Framework Safety Standards and Facilitation of International Trade of the World Customs Organization in relation to the criterions for the authorized economic operator is researched. Since their approval in June 2005 at the session of the Council of the World Customs Organization in Brussels, the Member-States have gained a considerable experience in their practical implementation. In March 2016, DG TAXUD systematized the experience gained in the EU between customs administrations and the AEO and issued a guideline document entitled “Authorized Economic Operators. Guidelines”. The criteria for acquiring the status of AEO are presented in the Guidelines can be divided into three levels, each of which corresponds to a particular stage of the process of authorization of the economic operator of the chosen type. Thus, at the first level – the requirements are presented to the applicant, who must independently analyse his own activities for compliance with the original conditions, answer the questionnaire self-assessment questionnaire regarding his own “business practice” (business organization), choose the kind of status of the AEO for which he claims and establish a permanent connection with the relevant customs administration. At the second level, the requirements are addressed to enterprises and customs administrations, which jointly, by mutual information exchange and consultation, should bring the performance of a particular enterprise (taking into account its business environment) to the general conditions of the status of AEO. At the third level – the assessment criteria are checked by the customs administrations of the EU countries. The scope and nature of assessments depend on the type of status claimed by the applicant.
