Culturally Motivated Crimes – Viable Options for Criminal Adjudication

Abstract
The purpose of the paper is to outline the category of culturally motivated crimes and to delineate the characteristics of this class of behaviors. In addition, it describes alternative responses to acts falling within category. Hypothetically, some culturally motivated acts could be treated as the types of crimes that have already been defined under Polish criminal law, which would be indicative of society’s disapproval of the incidence of such crimes. Attention is also given to the likely effect of cultural motivation on such aspects of criminal offenses as mens rea or culpability. Should such factors be brought to bear on criminal adjudication, consistent with the principles of a fair trial, they might, in many cases, mitigate or waive criminal liability altogether through the application of what is called “cultural defense”.
