Swobody rynku wewnętrznego a zasady demokratyczne Unii Europejskiej w orzecznictwie Trybunału Sprawiedliwości UE

Abstract
Celem artykułu jest przybliżenie wybranego orzecznictwa Trybunału Sprawiedliwości Unii Europejskiej dotyczącego rozstrzygnięć o zakresie swobód rynku wewnętrznego (do czasu przyjęcia Jednolitego Aktu Europejskiego z 1986 r. określanych mianem swobód wspólnego rynku) oraz zasadach demokratycznych stosowanych w praktyce działania Unii Europejskiej i jej instytucji. Główną tezą artykułu, jaka wyłania się z wyroków Trybunału, jest niesprzeczność swobód rynku wewnętrznego i zasad demokratycznych. Zwornikiem, który pozwala łączyć te dwie, nie zawsze zgodne, grupy wartości, jest koncepcja praw podstawowych przynależnych jednostce.
