From Augsburg to Augsburg: emperial legal acts regulated freedom of the Protestant’ faith in the middle of the XVI cent

Abstract

The article analyses the legal acts of the Holy Roman Empire reichstags and personal of Charles the V Habsburg devoted to the freedom of Protestant faith from 1530 till 1555. Comparative-legal analysis of the political, social and military conflicts circumstances and its influence on the substance and application of these acts are provided. Conclusion is that liberalization of the freedom of faith was the main vector of legal imperial regulation. The legal acts promulgated in the periods disadvantageous to the Emperor constantly fix the Protestant princes’ benefits, liberties and integrities of their possessions. On the other hand the legal acts promulgated after the Emperor’s victories and in the advantageous situations are also beneficial for Protestants compared to the previous period. Existence of their religion is not denied and the territory of its spreading is not declared heretical.
