Громадянське суспільство в Україні: історико-правові аспекти становлення та розвитку

Abstract
Простежено історичний процес формування та становлення громадянського суспільства в Україні у ХХ столітті; здій-снено аналіз громадської думки, що вплинула на формування громадянського суспільства та встановлення незале-жності; визначено здобутки і прорахунки громадянського суспільства, перспективи його розвитку відповідно до демо-кратичних процесів в Україні. Прослежен исторический процесс формирования и развития гражданского общества в Украине в ХХ столетии; про-анализирована общественная мысль, которая повлияла на формирование гражданского общества и установление независимости; определены достижения и пробелы гражданского общества, перспективы его развития в соответствии с демократическими процессами в Украине. The article traces the historical process of formation and becoming of civil society in Ukraine in the twentieth century; an analysis of public opinion influenced the formation of civil society and the establishment of independence; the achievements and miscalculations of civil society, prospects of its development in accordance with democratic processes in Ukraine are determined. The Declaration on State Sovereignty of 1990, the Act of Independence of 1991, and the Constitution of Ukraine of 1996 proclaimed the principles for the formation and development of civil society in our state. The urgency of the study on this issue is due to the contradictory interactions of civil society with the state in the political, economic, social and cultural spheres, and Ukraine's course towards European integration requires the improvement of the legal principles of its development. For the young Ukrainian state, the issue of the need for parallel development of civil society and state institutions, in particular, the growth of public control over the exercise of state power, remains a topical issue. The degree of democratization of the state depends on the degree of development of civil society. Attempts to rebuild statehood were made by the Ukrainian community during national liberation competitions, which showed a high degree of self-awareness. However, the narrow social base of the national liberation movement, the lack of unanimity in the actions of leaders led to their defeat. In the future, the existence of a national elite under totalitarian, communist, authoritarian regimes limited its ability to fight for independence. The organizations of the 1960s and dissidents in the 1960s and 1970s, as well as the human rights organizations of the UGG, the UGS of the 1970s and 1980s, formed a solid foundation for gaining the Ukrainian people by their protests, actions, creativity, and self-publishing, were important forms of civil society in Soviet statehood. independence in 1991. The fall of the communist regimes has given rise to new debates on the formation and development of civil society. Analyzing the attitude of Ukrainians towards institutions of civil society, it should be noted that we have not yet formed an awareness of its capabilities. In the short term, the development of civil society must move towards the creation of independent media; formation of social values such as pluralism, tolerance; an increase of social activity of citizens; mastering the legal culture.
