HIGHER EDUCATION AS A LEGAL CATEGORY: NORMATIVE AND DOCTRINAL ASPECTS

Abstract
The article highlights the genesis of research of higher education in the legal science, determines its complex nature, features of analysis by representatives of various branch legal sciences, highlights trends of modern research in the do- mestic administrative and legal science. The author analyzes the specificity of the normative definition of higher education in the domestic legislation in the ХХ – ХХI centuries, the basic models of such fixation are singled out. The author suggests a list of features of higher education, which together form the resource of higher education as a legal category, and for- mulates its own definition of higher education, which is proposed to be used in doctrinal legal, including. administrative-le- gal, research, as well as enshrined in legislation. The consistency of the author’s definition of higher education with the definition fixed in the European normative legal acts is grounded, it will promote unification of the domestic and European legislation on higher education, Ukraine’s entry into the European legal space of higher education.
