Interpretation of the term «vulnerable state of a person»: legal definitions and modern law discourse

Abstract

The paper deals with the problems of the legal definition of vulnerable state of a person. Articles 149, 258-1 and 303 of Criminal code of Ukraine are investigated. It is envisaged that the ‘terminology gap’ is one of the main causes of the legal defi- nition problem of the vulnerability. It is proposed to replace the words «vulnerable state of a person» with «Vulnerable Situation» in Articles 149 and 303 of Criminal code of Ukraine, but it would be reasonable to leave the text of Article 258-1 as it stands.
