LEGAL ANALYSIS OF THE LAW OF UKRAINE “ON THE PRODUCTION AND TURNOVER OF ORGANIC AGRICULTURAL PRODUCTS AND RAW MATERIALS”

Abstract
International Jump to the formation, establishment and development of organic production, the trend towards the consumption of environmentally friendly (organic products), the legal protection of life and health of plants and animals, biodiversity, improving ecological environment in general, etc. European integration path lead to the need for Ukraine the development, establishment and implementation of this type of mass production in Ukraine. In addition to the introduction of a mechanism such as management science from the category of agriculture, there is a need in the legal category: there should be the existence of the relevant legal provisions that can regulate outlined social relations. The peculiarity of organic management is based on supporting documents – especially when exporting such products, the lack of which can not be attributed to organic agricultural products. However, there is no requirement as for the impossibility of referring such products to clean ones is concerned, which in its essence is similar to organic, but contains no mandatory requirements - certification. Due to economic, natural and social potential of Ukraine - there is a real need to secure regulatory legal acts of two kinds of entities: organic, environmentally friendly. Immediately, and traditional management will continue to exist. Given the time period of development and implementation of legal regulation of organic farming in view of the present conditions it is appropriate to make a legal analysis of the basic Law of Ukraine "On the production and circulation of organic agricultural products and raw materials." The Law which aims to the development of agriculture of Ukraine in the direction so called as organic production and production of environmentally friendly products (raw materials). This basic law itself shall contain all the key positions starting from terminology and ending with the appropriate types of liability. Availability of somewhat controversial, something controversial legal provisions for outstanding subjects of procedures, the severity of determining the priority actions of an interested person who wishes to qualify for organic production, etc is a real fact which should be uniformed by rules of law.
